• ARTICLE 2 - GENERAL PROVISIONS RELATED TO THESE GENERAL TERMS OF SALE

1. Purpose of Terms of Sales

Terms of Sales are applicable exclusively to the online sale of Curanomy Ltd products on the Curanomy.com site, (hereinafter the site) whose access is open.

2. Scope of term of Sales

3. Availability and opposability of terms of Sales

• ARTICLE 6 - ORDER

• ARTICLE 9 - DELIVERY

1. Definition

Delivery means the transfer to the consumer of physical possession of the goods.

2. Shipping Time

Under normal conditions, the professional seller will process the order as soon as possible from Monday to Friday, excluding holidays. Curanomy Ltd undertakes to ship orders within 48 working hours following validation of the order and subject to available stocks.

3. Delivery time

The prepared order will be delivered to La Poste or its subsidiaries (letter followed, Colissimo, Delivengo, etc.) or to Mondial Relay, or Amazon, at the customer's choice. , for delivery within 4 to 7 days in Metropolitan France or Belgium.

Orders to overseas territories or abroad will also be shipped by the same services or their subsidiaries and delivered by their partner local. Delivery times differ according to region or country of delivery.

A fast delivery option is offered from Monday to Friday for customers whose delivery address is located in London or Paris. Orders validated before noon are processed the same day to be delivered by the address indicated. Beyond 12 noon, delivery will be made in the evening of the 3rd working day. In case of impossibility of delivery because of the customer, the responsibility of Curanomy Ltd could not be engaged.

In order to facilitate the delivery of the order by the carrier, the customer undertakes to make the necessary efforts allowing the parcel to be delivered: name visible on the mailbox, transmission of the digicode, telephone number.

4. Late delivery

In the event of a delay in delivery of more than 7 working days, the customer must inform Curanomy Ltd customer service who will implement the necessary actions and adapted.

5. Place of delivery

6 . Product conformity

7. Transfer of ownership

From the delivery date indicated in the order form, the ownership of the product is transferred to the buyer, except in the case where the payment full price was not cashed on order.

• ARTICLE 10 - PRODUCTS RETURN AND RIGHT OF WITHDRAWAL

The consumer has a right of return of fourteen days from receipt of his order to return any item that does not suit him and request an exchange or refund, with the exception of the return costs which remain payable.

Returns must be made in their original condition and complete, allowing them to be resold in new condition. Any product opened or damaged by the consumer will not be taken back.

In the event of withdrawal Curanomy Ltd will refund all payments received. Either by re-crediting the consumer's credit card or Paypal account, or by bank transfer depending on the method of payment for the order.

Curanomy Ltd may defer reimbursement until receipt and verification of the products.

Exception to the right of withdrawal Exercising the right of withdrawal is excluded for the following contracts: - contracts for the supply of goods likely to deteriorate or expire rapidly; - contracts for the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.

• ARTICLE 12 - DISPUTE RESOLUTION

Curanomy Ltd cannot be held liable for damages resulting from improper use of its products.

• ARTICLE 13 - APPLICABLE LAW

This contract and the T&Cs governing it are subject to UK law.

If a Customer is acting as a consumer in accordance with clause 1.2, any contractual relationship between the parties is governed by the law of the country where Customer is domiciled, excluding the United Nations Convention Governing Contracts for the International Sale of Goods, and Customer shall be under the exclusive jurisdiction of the courts or tribunals of the state in which Customer resides with respect to any dispute under these relationships. If a Customer acts as a consumer in accordance with clause 1.2, any contractual relationship between the parties is governed by the law of the country where the Customer is domiciled, excluding the United Nations Convention governing contracts for the international sale of goods, and the Customer will be under the exclusive jurisdiction of the courts or tribunals of the State where he resides regarding any dispute within the framework of these relationships.
